The American government

It’s a federal system with elections to different levels. The political responsibility is divided, but the presidency stays the cement of the nation.

 

I)The Executive Power

The president controls the totality of the executive power to the federal level in the limits of the constitution. He names the state employee and manages the administration, which are divided in departments managed by the secretary of the state. This minister is named by the president and is responsible for mistakes.

The Congress can give advice about the composition of the presidential team but it can’t give censorship. This absence of responsibility of the executive power, which presides over the legislative power, so the American system is a presidential system and has no a parliamentary system.

The president is elected every fours years by the electoral collages, who are elected by the citizens.

During the meeting with his minister, the president is the only one to choose the subjects that will be discussed; he makes his own decision. He doesn’t need to follow the majority.

II)The Legislative Power

The legislative power on the federal level belongs to the Congress, which is divided into two houses: the Senate and the House of Representatives. The members of the Congress create the law. The president has the right to veto a law decided by Congress.

 

A) The senate

The senators are elected for six-year terms and removable by a one-third vote by the citizens every two years, they are elected by the direct universal vote.

Each state has two senators, so there are 100 senators. In case of absence of majority, the vice-president, who presides over the senate, participates on the vote to obtain an odd number.

 

  1. B) The house of the representatives

There are 435 representatives; they are elected by district, determined by the population. It’s the representatives who vote for the budget, so the legislative branch controls the executive.

 

III)The Judiciary Power

The Supreme Court is formed of nines members, named for life by the president. They judge on content but on the form, as the last resort of the federal judgments given by the federal court. Since 1816, it gives itself the right to give a judgment in appeal on the arrest of the federal tribunal.

It shares with all American tribunal a competence about problems between people and the administration. It also returns arrests on the conformity of the administrative texts with the constitution.

The power of the Supreme Court is considerable, but limited. In fact, it can’t choose its cases, it’s necessary that the defendant choose it.
