With its decision of 12th May 1998 (312 O 85/98 'Liability for Links') the Regional Court of Hamburg has ruled that the setting up of a link implies accepting the joint responsibility for the content of the linked site, if applicable. According to the Court’s decision, this can only be prevented if the owner of the concerned website expressly distances him or herself from the content.
